Legal Question in Banking Law in India
can a retired employee be asked by the bank(employer) to remit the excss salary paid? My mom has NOC and with no dues she got her retirement in Nov2010. and post 2 years of her retirement(dec 2012), she has been asked by the bank to remit an amount of rs:50,000/ for excess salary paid during her service..Pls guide

When the bank has already issued a "no dues" certificate, where is the question of any recovery of excess salary after two years. The bank will have to explain the basis of how the excess salary was paid to your mother.

The fact is if any excess payment made by the employer he has right to get it back. No due certificate is given by the bank in respect of loan etc. not for dues related to job
