Legal Question in Banking Law in India
Sir,
I want to file a suit against a Nationalised bank. Before filing suit i want to deposit the entire amount which shows as debit balance in my account. which are the best. options available to me.
( 1 ) Can I deposit the amount in form of Fixed deposit receipt or postal certificates with the Honorable court along with filing the suit? Whether honorable court will accept this? ( Since the amount is around four lac, i don't want to lose anything by way of interest. Investment in postal certificate of fixed deposit will earn interest little less than that of lending rate interest of the bank.)
(2) while filing suit with honorable Court can I enclose a demand draft favouring bank with a mark as "UNDER PROTEST" whether the bank will accept the amount as "UNDER PROTEST" Whether this procedure this safe for me?
You may kindly let me know the best and safest way in this issue.
