Legal Question in Banking Law in
I was out of station and my brother given my cheque to his friend of Rs. 100000/- niether I signed it or nor given any consent to give the cheque to his friend I was in dark. My signature is not matching. My brother's friend presented the cheque in the bank and take a certificate of non sufficient fund in the account and filed a case under section 138.

You will have to defend the case to prove that the cheque was not issued by you and it is a forgery. You have to take the assistance of local lawyer for defending the case.
