dear sir

im started part time business of home based bpo projects so its very nice going so I suggested to take my friend also so his also took then both are wil continuing last one year but suddenly the company doing delay and as well as stops their reply every thing completely so my friend asking me about this and my friend filed case against me to settle my payment and all in consumer court so that decision also said to settle soon so now i need to stay of this current decision until I got from the concern company so

but actually I wil also invested on company so I must recovery from their so I must settle else not now so kindly tell me the solution of stay order how should I proceed ?

Dear client,

First of all you need to file an appeal before the State Consumer Redressal Commission and file an application to STAY the opetation of the order of the District Consumer Forum till the disposal of the Appeal.

The points to be noted while filing the Memorandum of Appeal is as follows.

This case is not coming under the jurisdiction of consumer forum, there is no seller buyer relationship between you and friend.

The Principal company to whom you worked is not made as a party in the earlier proceeding in the ealier proceeding- so the defect of non joinder of necessary parties is also there.

Since you had not compelled your friend to invest in a business like this, it was the duty of your friend to use some brain and invest, since it is a business there is every chance for profit and loss, while in profit he was happy.
