Poneroy contracted to make and deliver 10,000 pairs of shoes to Henderson by October 1st. A strike of Poneroy's employees prevented him from fulfilling his contract in a sue by Henderson for breach of contract, Poneroy claimed that the contract was terminated by impossibility of performance. Was his defense good?
