SIR, There is a partnership firm whiich is not dissolved but due to dispute works are not carrying out properly. there are three partner. 2 partner want to start a same new business with same name . wether they can use the same name and get registered themselves. There is no restriction in there partnership deed. deed is silent.

Dear Sir / Madam,

A partner can be a partner in a total of 20 other registered partnerships as on date. Moreover, since there are no restrictions in the partnership deed to prevent the existing partners from to starting the same or a business similar in nature to the business of that of the disputed firm, the two partners can form and register a distinct separate partnership firm. Caution : The name of the new firm cannot be the same as the name of the disputed firm.
