Legal Question in Business Law in India

Sir,

I have been selected in India Meteorology Department as Meteorologist. But Just before its joining I also selected in Indian Engineering Services, but joining of Indian Engineering Services would take 9-10 months now. India Meteorology Department has a bond of Rs 2.5Lakhs for 3 years and also I didn't get NOC as I have not joined the service yet. Can I join Meteorology department in this duration and resign after 9 months ?? what are the legal issues involved in this case ?

Can I tranfer my service bond? Will The Meteorology department have any objection on joining other department ?

Thanking you

Dear Sir / Madam,

You should have the selection letter from the Indian Engineering Services (IES) clearly stating your joining date as 9-10 months from now. Otherwise, that future selection is not guaranteed, and is hypothetical and meaningless. You should request the Meteorology Department to waive off the bond condition, which they may not agree to. Only if you already have the IES selection letter with the future joining date, you should first check whether both the organizations fall under the same or similar State or Central Government or semi-government undertakings, and ascertain and confirm whether the prevailing Government rules and regulations and conditions that permit the transfer of the employment Bond you are signing with the Meteorology Department, to the IES if you join them 9-10 months from now. In my opinion, if both establishments do not fall in the same or similar category, transfer of Employment Bond is not permitted. If you do not have the IES selection letter in your hand, you should simply take up the job in the Meteorology Department as a Meteorologist by signing the Employment Bond, without raising any doubts or questions.

In the event of transfer of bond not being permissible, you run the risk of paying up the money to the Meteorology Department, for breaking the bond before its completion.
