Legal Question in Business Law in India
Can a subsidiary company can issue Non-convertible debentures to pay the dues of the parent company? If No, then why? Is there any leading Indian Case Law which could answer the given question? Since American Law generally allows the financial institutions to sue the subsidiary company for the dues of holding company, so the moot question is the whether financial institutions or banks can sue the subsidiary company for the debts of parent company?
