Sue owns a plant nursery business in New Jersey and arranged to have paw paw trees imported into the state. The importation of fruit trees violated a New Jersey statute. Sue was indicted under a federal statute that makes it a federal crime to transport nursery stock in interstate commerce in violation of a state law. Sue made a motion in court to dismiss the indictment on the ground that the New Jersey law unconstitutionally burdened interstate commerce.
