Legal Question in Civil Rights Law in India
Agar lower court me kisi ne insufficiant court fees bhari ho aur humne is kami ko court ko btya ho ( order 7 rule 11 code of civil proceedure 1908. K madhayam se) aur court ne hamari application k base par additional issue frame kiya ho. Jisne insufficiant court fees ka reason gareeb hona bataya ho. Fir court ne gareebi ki application bhi reject kar di ho.
Toh kya itna sab hone k baawjood bhi judge insufficiant court fees ki bat ko avoid krke uske huk me judgement de sakta h jisne insufficiant court fees bhri ho. Judgement me kisi high court k do cases ka hawala dekar fees maaf kar di.
Kya ye kaanuni roop sr sahi judgement h ya nahi. Plz reply
