Legal Question in Civil Rights Law in India

We have some agricultural land in our native. In front of the land, another person bought 20 cents of land. We bought 15 cents of land nearer to the road (in front of the 20 cent land). As per the survey numbers and patta there is no access to the main road for the other party. We have fenced our land, but given some way to the other land owner to access the main road. Now he is building a house in his land. Meanwhile, he has broken some parts of our fence without asking us and also fought with us. We are planning to take legal action against him. Just wanted your answer on following queries.

1. Does the person have right of way to the main road eventhough he doesnt have way to the road.

2. If we take legal action for breaking our fence, will it stand in court?

3. If we close the access to the main road through our land, will there be an issue?

4. what should be our next course of action if we take it to the court?
