Legal Question in Civil Rights Law in India
Background: Recently the passport office of kolkata has fixed a penalty of Rs 2000/- to my relative who is a minor (age 16). The girl with her mother appeared Passport Seva Kendra for a new passport whereas she has an old but expired passport. She and her mother thought since the old PP has expired (i.e not valid) they have to apply for a new.However , the girl has been issued a letter asking for penalty.
Question 1) Can any minor be penalized ? 2) If not please inform the Act,Rule with section .3) Can any penalty be absolute without providing opportunity of being heard (There is no Appellate Authority for appeal in PP cases)
