Three brothers A,B, C were joint pattadars, joint owners and jont possessors of some land. Out of the three brothers two brtohers A & B were died leaving their sons and daughters and one of the said three brothers C is still alive. In the year 2004 the said living brother C and the other two brothers i.e. A & B`s sons were divided the said land into three equal shares through registered partition document and there by the suit land fell to the share of two sons of one of the the said three brothers i.e. B and the said brother B apart from two sons i.e. x & y three more daughters q r s also there but they were not made as parties to the said registered partiton document through they are also legal heirs of their father B and taking un-due advantage of the said registered parttion docuemnt the said two sons ha x and y have sold the suit land to the third parties. Now the legal question is whether the three daughters q r s are entitle for partion of the suit land if so how much share will come to them ?
