Legal Question in Civil Rights Law in France

To whom it may concern, we are an australian gay couple living in france. One of us has a carte de sejour for 2 years and is a scientific researcher, the other is on a tourist visa only. We where told the only way for both of us to stay is to get married. After 2 months of gathering all the documents require to marry, we feel we are being discriminated against.

We have proved all the paperwork requested but with each visit to our local Mairie office they change what they want. After three trips and contradictory information provided at each visit, they are now saying that as gay marriage is not legal in asutralia then we cannot get married. We have already provided letters from the Australian consulate that is a letter of no impendiment to marriage.

We have lived gogether for 4 years and do not know where to go now. We have emailed several lawyers in paris but am not getting any responses. Any advice would be appreciated.

Full gay marriage is possible since 2003, so lots more experience.
