Dear Sir,

Father have Self purchase Property on my Mother Name (both) are alive we are Two Brother one Elder brother Kick out From Property by Legal procedure and Leave on Rent any where . Know he file a suite file against my mother .ME and my father in disst Court for Property Divide its is Possible he have any right of father property If NO so how Court Accept his Suit and 2nd quotation is Court give stay order on property my Father is very Aged he in Taint ion how is possible when all property is self purchase .. and my Elder bother do miss behave with father and mother . my mother already launched a complain in police station but no solution. plzzz help me

Dear Sir / Madam,

Your elder brother cannot file a case for division of property when your father is alive. No court in India will entertain that matter. Since you are taking care of your parents, you should ask your father what he intends to do with his property and since your father is aged, you should request that the property be transferred in the name of your mother by way of a nomination if it is a flat in the Society or a Will stating how the property title should be transferred after him.
