Legal Question in Civil Rights Law in India

Dear Sir/ Madam,

My parents and myself were living in a owned premises for many years, before my mother passed away in 2010. (Relationship between mother and father was not good since 2007, my mother had filed for divorce against him in 2007.)

Now, to harass me and to give away all my mother's rights to his second wife, my father has filed a case of injunction against me in 2013 in City Civil Court.

It has been 3 years since the case has not moved forward, he has not even gone for argument. He comes to court, takes a date and goes away. The judge has also indicated that such a case against a co-owner is not maintainable, however, he probably is dragging the case to just continue the mental stress to me.

My question: Is there any provision whereby I can request the Hon. Judge to just dismiss the case since it is delayed and is not tenable against coowner. What will be the procedure. Thanking you in anticipation.

1) Ask ur lawyer to insist not to allow further dates.

2) In 3 years, the case will not come for arguments stage, too early.
