Legal Question in Civil Rights Law in India
further to my earlier question I want to know the following
1. If the sisters of my father or their heirs raise objection in granting probate, on what ground they will object as already they had given consent for the same.
2.can any one of them objects on the ground they want to revoke their consent earlier give.
3. can they say the will was done earlier and may not be genuine though they know very well that the same was done by my grandmother in presence of them.
4. all the 3 witnesses have since expired. however their kins are ready to confirm the genuineness of the signatures of their father witness in the probate. can the court refuse to allow them for confirmation of signatories.
5. If the sisters/heirs object for granting probate, can it be defended further by us. if so, on what ground.
6.we the brothers of deceased only son of my grandmother are living in the house since birth. we have unregistered will of my grandmother deposited in court as contested earlier by my brother. Can the sisters/heirs of my deceased father evict/sue for eviction/ claim for share whlie we are occupying the house as residence.
please answer.
