Legal Question in Civil Rights Law in India
Self earned property, settlement deed was made to his wife one portion of a house and after her to the eldest son. Rest two grounds to two daughter and one son after his death by registered deed in 2003. In 2005 the deed was revoked citing that the other children did not take care and all the property mentioned to two daughter and son, will go to eldest son after his death, together with the house. Son has sold the vacant land and a flat was constructed and sold. Bank loan was given and now legal notice served by the other children. The case came in 2006 and in 2011 fast track court dismissed the case citing no show. Now one of the flat owner wants to sell the flat, but SBI bank need NOC from the plantiff. Is it legally valid for a NOC as the case is already dismissed
