Legal Question in Civil Rights Law in India

we had filed criminal case against another party which was decided by session and district court in our favor.Accused filed writ petition and high court come to conclusion that this is civil nature complain so accused can not be face criminal action. Accused also submitted that this is civil liability so I cannot be trial under CRPC.Almost 17 years had been over. Is there any remedy for us to file civil suit against those accused to recovery of property and money on the basis of high court observation and submission of accused him self. We cannot file civil suit in need of stamp duty that time.

We had lost all our means of living . Please guide us.

Hi sir/madam, you can file civil suit for the same on the basis of observation made by the Hon'ble High Court if it in civil in nature, it is helpful to the period of limitation cause of action...., but you have to give court fees on the plaint. ... by Chandrashekhar Vithal Jadhav, Advocate, Bangalore.
