Legal Question in Civil Rights Law in India

i have filed a partition suite in front of sub judge(diss-purnia,state-bihar) .but the defendent is fox person and he take the "peskar" in his favour and din't file the written statement after the limeted period 90 days and judge is giving him time ellegaly now i want to know what should i do and which type of action i can take.

move an application before the court. it is the duty of the judge to hold the court and not that of peshkar.
