Helo I am. Neeraj ,

My father expired on 6th sep2013and will made on 30 th Sep.in 6th line he made will for my brother,his second wife and me.1/3 for us but my problem is in 7th line he wrote what ever rupees I have in my bank or post office or in every thing only for my second wife even his pension also and in all. F.D she is nominee.then what I do for right how I get my father property.?

Dear Neeraj,

It is not possible that your father passed away on 06th September, 2013 and the Will is dated 30th September. Presuming it is dated 30th September 2012 or some earlier years. Reading the 6th line implies that you, your brother and his wife have a 1/3rd share of his property. Reading the 7th line of his Will implies that your deceased father intended to give all cash balances in his bank or Post Office in savings, and in his FDs to his wife as the nominee. You should obtain a Probate from the Court on your father's Will and proceed ahead.
