I am K.N.D.Dass from Hyderabad, we have a combined property acquired from my grandfather in Eluru (west godavari dist, AP) House measuring 261 Sqyrds, our grandfather had 2 sons and 3 daughters (3 of them got married by 1978), my grandfather did not write a will for this property, and it was taken care by grandma after his death in 1971/72, she wrote a will in 1997/98 to my father and my uncle dividing the share equally (Is it a valid will?), it had been registered.
Property tax is paid separately, but power connection is common and shared.
Now my uncle has built a wall in between (not sure if he has built in his boundary), he claims that he has built the wall in his boundary.
He has not informed us about the wall in prior or after construction, also he is not showing any plan/layout for which he is saying the wall has been built as per the boundary.
The original documents are with us and site was purchase in 1929. We pay the property tax but when we approached the town surveyor to do the survey, he refused as there is no measurement of the plot mentioned in the documents.
Whom should we approach to get it surveyed and get out part safely, is it ok that we can file a case in civil court.
