husband purchased the site and then construted the property in the name of wife ,after the death of her husband whether her son(eldest son) is eligible to claim partition suit and decleration of giftdeed made by her(mother) to other 2 son's ,not making any giftdeed to her eldest son

Dear Sir / Madam,
After the demise of the original owner (husband) the property vests in the wife. Now, if the mother has executed a Gift Deed of the property in the name of her two sons without including the elder son therein, its her wish. The elder son cannot override the wishes of his mother.
