i made a sale agreement with for a property for 5,20,000. i paid 5,00,000 and kept pending of 20,000. we did registration also. but without my knowledge the seller again registered the property to his son and after three days he died. then the family members said within one year we will return the amount. Now they are delaying and there are only 5 months balance for the agreement. we like to go to court now. please help me whether our side will be strong?

Dear Sir / Madam,

YES, you have a valid case since the Sale Agreement is duly stamped and registered in your name. Besides the Court proceedings, you should specifically give it in writing to the Seller, that if they fail to handover possession of the property and the keys to you within 30 days, you will lodge a Police complaint thereto. If that situation arises, you should handover the cheque for the balance Rs. 20,000/- and take the keys of the property in the presence of the Police official.
