Legal Question in Civil Rights Law in India
My mom who expired few back back. She wrote a will and made the settlement documents legally when she was alive. Our own house in our village was in my father's name and she gave the shares equally to us (we are three brothers) and all agricutural lands, (which was belonging to my mom) she gave to myself and my brother who is mentally retarded and she didnt give any share to my eldest brother as he married twice (two wives he has) without permission of our parents and he made all sort of cheating and robbing from our parents. By keeping these things, my mom didnt like give any shares to him and so far, he and his wives never done any of their duties to our family and there are completely detached our family...no emotional support or finoncial support. Now my eldest brother family claiming that he is the one born to my father and all others are not born to our father and he is the one, eligible for taking all properties and not accepting the settlement and creating all sort of mental torture to us indirectly. So which way i can solve this. infact i am one who is taking care of my mentally retarded brother. My eldest brother threatening that he is going to kill us, etc. Please suggest us what to do.
