Legal Question in Civil Rights Law in India
Mother propertory,geting from her father as gifted.I am only elder son & another is my sister(married). How can I got my share from mother ? But my mother is avoid me from very resent.I am 49yr.I have a daughter,she passed isc & in feture I want to read in haier class.

Dear Sir,
Your mother can gift the property to you anytime during her lifetime, or she has to write a Will in your favour in case she wishes that the property should be transferred to your name after her demise. In case you mother does not do either, the property will be divided 50 - 50 between you and your married sister.

If it is gifted to her by her father; she can do whatever she likes.
You cannot force her, nor law ca force her to give anything to you. If she dies intestate - both children, i.e. yourself and your sister will get an equal share.
