Legal Question in Civil Rights Law in India

Mu father is living in a house which is situated in corner side of the society. He has purchased the same 20 years ago. When he has purchased the same the transferor has taken extra consideration for the parking area which is between his neighbour's wall i.e. a common wall falls between two houses. The matter is related to this margin land which do fall in ownership of neither my father and nor his neighbour. He is living in this house since 20 years and his neighbour has never claimed for the same uptill now. But before some daus before he went to municipality office and fetch some orders saying to demolish the said common wall otherwise an order to demolish forcefully the said wall will be passed under section 260 of the B.P.M.C. Act. The said notice was signed by an unauthorised person of municipality office and for which the neighbour is harrasssing my and other family members. On the said common wall only a weather shed has been constructed, is this falls under a legal construction. ? My father has filed a suit in court of law demading permanent injunction. My question is to confirm that whether my father may get the land legally in his name by successing in receiving the stay order ? Thanking you.

the matter is subjudice. has he filed a suit for declaration also?Only by getting an injunction he will not get the title or the ownership of the land.
