Legal Question in Civil Rights Law in India
I came to know in Novermber 2006 where my husband had divorced me in 1999 itslef by pronouncing triple talak in a letter which was sent to me by him by Registered post with AD and duly acknowledged by me then. He said then because of family pressure he did that and pleaded for that letter to be ignored and continued cohabited with me till November 2006. During 2003 we purchased a property in the joint names of us. In November 2006 he deserted me and my daughter(Minor) and now he filed partition suit for the property and is in trial stage. Am given to understand that as the property is in joint name am eligible for 50% of the share.Kindly guide me whether i can proceed him under any other provisions of law prohibiting from persuing this civil suit by him as I feel that it should not be treated normal civil suit for partition because during the period between 1999 and 2006 he made me believe that as if he was my husband?
