Legal Question in Civil Rights Law in India
In punjab state post graduation entrance seats are divided as such 60 percent goes to inservice doctors and from the other 40 percent the general category candidates and reserved category candidates are chosen. Just now another reservation was added in these 40 percent seats stating that 50 percent of these seats would be further reserved for candidates who have passed the qualifying examination which is mbbs from the state itself on the basis of 'institutional preference'. So we the students who have a domicile of the punjab state and have passed our qualifying examination from other states feel discriminated as it was only because the number of seats were so less in our state for undergraduation that we had to go out of the state in the first place. My question is that can we challenge this new reservation and what are the various grounds on which it can be challenged?
1 Answer from Attorneys
You can challenge this reservation on the ground of discrimination.
