Legal Question in Civil Rights Law in India
Qn.-Can a married daughter claim her right in Late father's (un-divided ) property ?
Sir, Mr. Ram Shah, aged 65 yrs., died in Apr'2013 & is survived by 02 daughters & 02 sons, all married & settled.
His wife died 10 yrs. ago. Daughters live at their in-law's places, sons at paternal home & depend on Father's proprties.
Sir, Mr. Ram Shah didn't make any will or, partiion & hence both sons are fighting for their share.
My question is whether daughters enjoy any Legal right over the property? If YES, what's procedure? & in case both sons
decline to give any part of proprty to daughters, how to handle
the situation by help of law.
**NOTE- Mr. Ram Shah lived very stressfull life due to sons & their wives mis-behaviour & used to discuss things with his
elder daughter-Asha Devi. Now, Asha Devi has decided to claim her right in property for some social service/ charity purpose
in Late Sri Ram Shah's name.
1 Answer from Attorneys
file a suit for partition and daughters will be entitled to their share.
