Legal Question in Civil Rights Law in India
our is a registered society of shopping complex , all the shops are closed on sunday which all the members mutually decided , i open my shop on sunday due to my clients come on sunday as it is a holiday , now the society comitee has passed in the AGM that they wouls penalised me of Rs. 250/- per sunday if i open my shop.
is it their right to impose penalty on me.As per mumbai municipal corporation ( k west ward ) they hv to closed in shops on thursday. plese advice

Dear Sir / Madam,
As the Owner of the shop, only you will decide whether to keep your shop open or closed and the Society has not right to force you to keep your shop closed on any day. The Society has no right to impose such a penalty. It was a prevalent customary practice earlier that shops in each and every town and locality in Mumbai remained closed on a particular day of the week. That practice has been abolished since 1975 all over Mumbai and you are free to keep your shop open 24/7 for all the days in the calender year.
