Legal Question in Civil Rights Law in India

I am residing in one of the flats owned by me which was built before nine years. there are six flats in my apartment. Only four car parking space was provided by the builder. I didn't buy the car parking space. there is severe water problem in our apartment. so, the three people who bought that car parking space have built there own underground water storage tank by their own and kept the watertank in the upstairs without discussing with anybody in the flat. Now they are asking the other three of us to share and use the common underground storage tank. The problem is, since we (myself & husband) are both going to work we have to use cans and containers to store water and use it. we are unable to run the washing machine. So we went to our builder and requested to solve our water problem by constructing a separate underground water tank in the common area for which we will pay separately. But the other flat owners are not permitting us to do the same. Kindly give me advice whether it is possible to build water tank in the common area and one more question is Is that car parking space can be used for water storage purpose?

Dear Madam,

You have to collectively address and resolve both, the water issue and the car parking issue and cannot approach the problem in isolation. Nine years ago, the builder must have utilized the maximum permissible area of land and constructed the building. I see no harm in you using the common underground water storage tank and also get a common water meter fitted to be equally shared amongst all the six residents. This will rid yourself the trouble of filling cans and containers of water in your house, and around the vicinity, as the designated car parking space cannot be used for storage of cans and containers. It is commonsense that when you are willing to pay the builder separately, you rather pay jointly for the water charges, which works out cheaper.
