Legal Question in Civil Rights Law in India
Respect Sir, My mother (aged 65, got married in 1975) has 4 brothers and two sisters. All of them are the successors for their great grandfathers property. After my mothers parents expired we came to know that the property was still in their great grand fathers name only. So my uncle (mother's elder brother) approached their 3 sisters to come and sign in the Sub registrar office so that the said property could be brought down to these 7 members. The property located in Central Bangalore was 17 ft by 110 ft in which there was an century old building and some 6 square space was left. But at the time of sigining on the document it was mentioned that the property is equally divided to the 4 brothers and 50 thousand rupees is being given to the 3 sisters. At that time my mother raised a question saying how can this kind of injustice can be done. For that her brother had told her that this is only for a documentation purpose you need not to worry we will give you good enough share. But later, we came to know that the property is being given to an builder for raising an apartment. At that time my mother went to the elder brother asking about the things happening for which he didn't gave any right explanation. But he told now you can't do anything as you have signed the document. For this we put a case on him for which we got injunction also. Before that our lawyer also told us that we have lesser hold on this case as my mother has signed on property papers. But my uncle (mother's brother) got his apartment finished and shared the apartments with the builder on 6 -6 to each of them. In which he kept 3 for himself and 1 each for other 3 brothers. And now we came to know that being the property is in court and we have got injunction also they have sold the property to some one else (means the builder part apartments are being sold) which is contempt of court i believe. I would like to know what else we can do to get justice. As we have been betrayed under good faith from my mother's brother.
