Legal Question in Civil Rights Law in India

Respected Sir,

I had applied for passport in the year 2010 and was delivered to me.I travel Hong kong in the same year.I was minor at that time.Now I found that due to hurry my parents had made a mistakes regarding my Date of Birth.Mine actual is 16/6/1992 but in the passport it had mention 26/2/1994.Even we got my BirthCertificate in the year 2010 and it has been registered as 26/2/1994.Everything happened because of our wrong infomation during my 10th board registration.My 10th mark sheet shows the wrong one too.Recently my sister who was born after me on 11th march,1994 had applied for the passport and those officer refuse to give her passport because of one month gap.Now I realize my mistake and need to change everything ASAP.Please need help to sort out this problem.Hope you help me.

Dear Sir / Madam,

Passport issuance procedures in India are very stringent. Date of birth is based on verification of original Birth Certificate or original School Leaving Certificate. You will need to reapply online to the Passport Office and attend your interview in person along with your parents at the Passport Office, for rectification of your Date of Birth therein. In your sister's case, what is the one month gap you are referring to - is that also a case of false date of birth ? Vadee saayee chatiyo - chaa khappay ? Trouble is brewing ahead for you. Be on your guard.

since date of birth has been mentioned wrongly in birth certificate as 26.21994. Passport authority can not mention the correct date of birth at your request. You have to move the civil court by filing a suit for declaration of the correct date of birth. In fact, correction has to be made with in 5 years from the date of completion of tenth standard. with regards to your sister, you can move the passport authority saying that her date of birth is correct and your date of birth is wrongly mentioned that is reason for 1 month gap. There is no difficulty for your sister. But you have not a good chance of success in your suit due to delay.
