Legal Question in Civil Rights Law in India

Sir,

My father is elder & has three brothers excluding him, in that my fathers first younger brother filed case against three brothers for mother maintenance under section 125.

My question is that my father & my father's brother's not partitioned the property of my grand father & it is under the control of my father's second younger brother & he is not allowing to partition that property.

Is there any option that my father can come out from this case & free.

Can we file aganst the case section 125.

Kindly suggest us

the case is for your grandmothers maintenance.You are wanting to escape the responsibility on the ground that the property is not partitioned!!. I really am surprised is maintaining your mother not a part of your duty do you need money for that too.you have a right to seek the partition of the property but if matters reach a point where the mother needs to approach the court for survival it is shocking.
