Legal Question in Civil Rights Law in India
Sir, my grandfather has two children. My father and my aunt. After giving my aunt her rightful properties (he gave her her mother's that is my grandmother's property and some of my grandfather's as well) and gave the rest to my father by dhananishchayam. So now, both my father and grand father has passed away. Since father passes away before he could give my mother the property rights, my grand father got her kayvashavakasha certificateand gave her his sammadapathram. So now, after his death, my aunt has claimed under Hindu succession act for grand father's property. Is there any way to negate this?

Dear Sir / Madam,
Since your grandfather has already done the dhananishchayam of his remaining property in your father's name, there is no more of your deceased grandfather's estate remaining to be shared amongst surviving heirs, so your aunty's claim on non existing property estate, will not hold in the eyes of the law.
