Hi sir/ madam,

This is rohit my question is as follows

My grandmother has two children one daughter and son.her daughter who is my mother my grandmother has bought a property on the name of her and his son who at that point was sating in usa later he came back and got married in India after marriage couple of years the property which was a joint property due to some reason my grandmother transferred the property as a gift deed to his son and from him it was bought by his wife now both my grandmother and his son have died and the property is on his wife name my question is does my mother have any right in this property.kindly answer my quire which will be a great help.thanking you .

If your Grand mom has transferred her share only then you have a claim and if your mother has also transferred her share too then you have no right. You may drop in a detailed query at [email protected]

Dear Sir,

Going by your query, if your grandmother initially purchased the property in the name of your mother, your grandmother has no subsequent legal right to gift the same property to her son, simply because your grandmother ceases to be the owner of the property. The Gift Deed made by your grandmother in the name of your uncle is null and void. The title of the property should still vest in the name of your mother since it has been purchased in her name.
