Legal Question in Civil Rights Law in India

Hi Sir,
i have booked a flat in prelaunch offer and the builder gave me the legal documents after 2 month.
it is BDA approved project. When i checked with Lawyer, he said that family tree of Ancestor is required as the current owner don�t have proper relationship with Ancestor. The land was divided by original owner�s relations after his death. We don�t know whether any legal heir for the original owner
When i checked with builder, he said that he is not ready to get that from BDA/BBMP as they will ask more money. And he mentioned, if you don�t wish to continue without that document you can cancel the project.
Now, they are saying we will deduct the 5% of total basic unit cost of the project and will give the balance.
In the booking form, it is mentioned like incase of cancel, the 5% of the total basic unit cost of the project will be deducted. i have signed the form.
That means they will deduct 75,000 from the booking amount of 1 lakh and they will give me only 25000
but here, I�m cancelling because they are not ready to give the document.
Can i file a case against them? Is it possible that win the case in my favour.

yes you can file a case against the builder in consumer forum.
