Legal Question in Civil Rights Law in India
My sister,now deceased,has made me executor of the three-fourth part of a house with the responsibility towards maintenance and sale.But i have put a tenant in that undivided property though i did not get probate of the will and same has been lying with objection from the other co-sharer of the property.Now am i empowered to evict my tenant on leave and license basis which is also expired.Because the tenant is not paying the rent and not leaving the possession. Kindly advice my fate or future course of legal action.

If the tenant was inducted by you, he is liable to pay you the rent. You should be entitled to seek his eviction for non-payment. A local lawyer handling rent cases should be able to help.
