Legal Question in Civil Rights Law in India
In a Specific Relief Suit consisting of Plaintiff and Head of the Government Department, Government Office as Respondent.
The Head of the Department of the said Government Department filed a WS and was signed by him personally.
Later on Plaintiff filed a Petition for call for records / documents from the said Respondent (Government Department).
The Sub ordinate / Assistant Head of that Government Department filed a Counter Affidavit.
My query is that is such a Counter Affidavit filed by the Assitant HOD, Government Department prima facie valid ?

Yes, the counter affidavit is valid since the HOD has to prove and justify their stance in the Court.
