Dear Sir / Madam,
Q. Is my spouse's brother's wife (step father's son's) wife eligible for 3% Stamp Duty exemption on a Gift Deed being made to her. Does she come under the definition of "family" as per the Indian Stamp Act, 1899 to be eligible for exemption / reduction of Stamp Duty payable at the time of registration of the Gift Deed ?
A. Dear Sir,
"Family" includes the direct legal ascendents or descendents of the donor of the Gift i.e father, mother, son, daughter, grandson, grand daughter. Your spouse's brother's wife does not come under the definition of "family" and hence the prevailing 3% stamp duty is payable by the donor at the time of registration of the Gift Deed.
Regards,
