Legal Question in Civil Rights Law in India
There has been more than seven years of our marriage. Last month my wife committed suicide by taking poison. Now her parent filed a case against me and my family for dowry death which police has registered. My wife not left any suicide note mentioning that me and my family is responsible for her death because of dowry harassment.
I am Indian, and wanted your advice whether this case (dowry death) has any justified reasoning after seven years of marriage or if this is a valid case then please cite me some examples.
1 Answer from Attorneys
justification of a case or not depends upon various factors. It has to be seen whether the offence is made out by bare perusal of the FIR or not. In case the marriage was more than seven years old, it cannot be treated as a case u/s 304B rather it can be treated as a murder under section 302 IPC.
