Legal Question in Technology Law in India
I have developed a website where users can upload their files or text and get them encrypted (with AES 256) . The aim is to allow users to have more privacy ,so that corporates like Google and Facebook cannot spy on their personal files/text. My doubts are :
(a) is there any legal hurdle in making my website public ?
(b) do i need to maintain the decryption keys for all the users in case there is any request from the government to decrypt a specific user's file/text? If so, my website will also need the user's mpin to decode the specific decryption key, so if i don't get that from the govt then is my website still liable in any criminal way?
(c) is it enough if i charge users on a monthly basis and make them agree to Terms & Conditions ,where they agree that my website is not responsible for the use or intention behind their content and that they accept full responsibility for their content?
The users have to login via their social media accounts and provide an mpin to authenticate. Then they need to choose whom the file is intended for (themselves or a friend). The friends need to be added by mentioning their social media username. The encrypted file/text can then be sent by the user through any app or email that they like. My website's server does not read/see the user's data since it is all done on the browser window itself. To decrypt the file, the recipient has to authenticate their identity by loggin in via their social media account. Then my site will provide the decryption key and decrypt the file/text. My company is registered in India and the website is hosted on US cloud computers.
