check dishonoring is an offense of criminal nature which has the punishment of 3 years. It has nothing to do with the money. Civil case under order 37 of CPC is a civil case against the check which is of civil nature. There is nothing inhuman about it if you look from the law percepective or from the percepective of the one whose right is infringed. Another important thing is that many people do not get their money back even after both the cases. Supreme court is already trying to change the procedure of criminal case in this regard by empowering the police rather then the court.. However that does not seem to be a fair idea.
