Legal Question in Constitutional Law in India
The Supreme Court of India declared articles 124A, 124B, and 124C unconstitutional. The articles pertained to the NJAC. The decision may have been right on the merits or on the grounds of separation of powers, but wasn't it violative of the principle that one can't be a judge in one's own cause? These articles had been inserted by the Constitution (Ninety-ninth Amendment) Act, 2014, s. 3 (w.e.f. 13-4-2015). This amendment was struck down by the Supreme Court in AIR 2016 SC 117. I look forward to filing a PIL in this regard.
