Legal Question in Construction Law in India

Dear Sir/Madam,

I have taken home loan from DHFL, My Builder has not allotted me car parking, Not completed Lift work and Drinage system. But my builder claimed all the loan amount from the Banker. Banker has signature on part disbursement letter at the time of home loan documentation. He has handed over the document to the builder for claim the balance amount. But the Major Works like Lift and Car Parking is pending. I have complaint the same to the DHFL Branch Manager, No resonpon and complaint to Senior Officials no response. Banker Paid the amount on 29.01.2014 even today also lift and car parkings are pending. how can i take action on Banker and bilder. Pls. Suggest me

Dear Sir / Madam,

You should sue the builder and the bank for not adhering to stipulated conditions of the Agreement for Sale. You should instruct the bank that it will be solely liable and legally responsible if it makes any further payments to the Builder / Developer without your explicit approval and consent stating clearly that you will straightaway disown liability to repay it to the bank.
