Legal Question in Construction Law in India
Myself and my sister signed contract with the builder and undergoing house construction. Contract contains arbitration clause unaware of it we signed it. Now the builder cheating us and we couldn't reach to general court.
My question is my father is the plot owner and he is not involved in this contract anywhere. My father is alive and healthy. Is it possible to invalidate the agreement stating the property owner (father) is not involved in contract?

Even if the Arbitration clause is there, you may invoke the same and start the arbitration process. Despite the fact the plot is in the name of your father but the contract is with regard to the construction of the same.
