Legal Question in Consumer Law in India
I have booked two bed room apartment and enter into agreement after paying initial money with a completion period of 1 year. After 9 months, the builder converted two bed room apartment into duplex 3 bed room apartment and asking for double the money. The builder did not get the revised plan approval till date. I have meade payment 85% as per payment schedule for two bed room flat, The builder delayed more than 18 months from the schedule date as per agreement. The builder is not responding even registered letters. I had a Meeting with builder. The builder given two options:
Option 1: Your money will be returned + 3 lakhs will be paid as an interest etc. if you surroundered the flat.
Ption 2: If you wants to continue than Rs.3.75 discount will be given on the total cost of 3 bed room duplex flat (double the cost of two bed room cost)
The builder is not officially informing when he will be obtaining revised plan approval, registration, handingover of the flat. Without plan approval it is not possible to get bank loan. All flats are aready for occupation. The builder is completed the construction and registered all two bed room apartments and handedover the same except converted 2 bed rooms into 3 bedroom duplex apartment, which are very small number.
