Legal Question in Consumer Law in India
I have a commercial property in Bangalore rented out to a Central Govt. Organization. We had a rental agreement which expired on August 2012. Their office have completed 10 years in our building and have been paying rent accessed by the CPWD during the year 2001. Since it has been 10 years after assessment of the rend, I demanded the office to enhance the rent to as per the present market price prevailing in the market according to the CPWD assessment to be done now. The rental agreement was revised once during 2007 as their agreement was required to be executed once in 5 years with an increase of 15% for 5 years. For example if they were paying 10,000/- for the period from 2002 to 2007 the rent would stay constant for the whole 5 years and after the renewal of the rent it would get enhanced to a mere 15% for 5 years and I would be getting an additional of 1500 on 10,000/- which will be 11,500/- for the next five years. Since I objected to this and asked for analysis according to prevailing market price the Govt. office is not responding and have overstayed in my office building for close to two years without a legal rental agreement but are paying rent every month according to earlier agreement rate price. I am suffering huge loss because of this action of theirs and also have found out that they are trying to relocate to another office. I seek your legal advise. Please help.
