Legal Question in Consumer Law in India

Hi..
I went to consulting company who helps in immigration. I was not sure if i am eligible for the immigration or not and hence ask them what if i am not eligible at all. They said in such scenerio they will refund the 70% of the amount paid. Hence i paid them the first installment of the fees but when they got the agreement refund clause was never mentioned on agreement, so i said i wont sign it unless it is there. Meanwhile i came to know that i am not eligible for the immigration. When i asked for the return they didnt paid back and they have been avoiding me since. it has been a year, can anything be done on this?

serve them with a legal notice and demand your money if they avoid you may approach the consumer forum against them.
